TERMS and CONDITIONS
By making a booking, you and your guests agree to abide by Cairns Aquarius Holiday Apartment’s Terms and Conditions.
1. Booking and Payment:
a. A deposit may be required to secure your booking. The deposit amount and due date will be communicated at the time of booking.
b. Full payment is required prior to check-in. The specific payment due date will be communicated at the time of booking.
c. Payment methods accepted include credit cards and bank transfers. Please ensure that all payment details provided are accurate and up to date.
2. Cairns Aquarius Holiday Apartments are not liable to you if:
a. You fail to provide accurate booking details, e-mail address, or credit card information.
b. Despite our best efforts, any information provided is incorrect, incomplete, or misleading.
c. Any of the offered facilities are temporarily unavailable due to technical issues, maintenance, or renovations.
d. The property is withdrawn from the rental market by the owner.
e. Any of the offered facilities do not meet your individual preferences.
f. Your booking agent (e.g., Booking.com, Expedia.com) makes an error or does not communicate your booking information.
g. You have selected incorrect arrival and departure dates.
h. You or your guests lose or damage personal belongings.
i. You or your guests experience theft of personal belongings.
j. You or your guests sustain any injury.
k. Unsuitable weather conditions occur during your stay.
3. Special and Specific Requests:
a. Special and specific requests, such as bedding configurations, are subject to availability and cannot be guaranteed.
b. Additional charges may apply for certain requests. Confirmation of these requests will be provided only once the additional payment is received.
4. Check-in and Check-out: a. Check-in time is 2:00 pm on the day of arrival. Early check-in may be available upon request at least 7 days in advance and is subject to availability. Additional fees may apply.
b. Check-out time is 10:00 am on the day of departure. Late check-out may be available upon request at least 7 days in advance and is subject to availability. Additional fees may apply.
5. Occupancy Limits and Additional Guests:
a. Each property has a maximum occupancy limit. This limit must be strictly observed and exceeding it may result in additional charges or eviction from the property.
b. Prior approval is required for additional guests not included in the original booking. Additional fees may apply.
6. Refund Policy:
a. A refund will only be provided if your booking is cancelled at least seven (7) days before your scheduled arrival date.
b. If you cancel your booking within seven (7) days of your scheduled arrival date, the deposit will not be refunded.
c. If you cancel your booking within 24 hours of your scheduled arrival date, the total booking amount remains payable.
d. If you fail to arrive on your scheduled arrival date, the total booking amount remains payable.
7. Party and Noise Policy:
a. Cairns Aquarius is a mixed-use building, accommodating residents and long-term guests. We enforce a strict “No Party, No Excessive Noise,” and “No Anti-Social Behaviour” policy for the benefit of all occupants.
b. We reserve the right to decline bookings for group events or parties.
c. Parties and excessive noise are not permitted in apartments, and only registered guests are allowed in apartments after 10 pm. d. Failure to comply with these policies may result in eviction from the property and forfeiture of all accommodation fees paid.
8. House Rules:
a. Smoking is prohibited inside the apartments and in any common areas, including the pool and other outside areas.
b. It is the responsibility of parents or guardians to ensure that children are supervised at all times while using the swimming pool, lifts, common areas, balconies and windows. Glass is prohibited from pool areas.
c. Pets are not allowed on the property.
d. Guests are expected to maintain clean living space and are responsible for any damages or excessive cleaning required as a result of their stay, including disposal of rubbish and washing dishes or cooking equipment.
e. Guests must report any damages, breakages, or maintenance issues immediately to the property management.
f. Guests must dispose of rubbish and recycling in the designated areas.
g. Guests must ensure that exhaust fans (if fitted) are used during cooking and that excessive smoke is prevented from activating the fire alarm. Fire alarm activation due to cooking can incur a fee of $1500 from Queensland Fire and Emergency Service.
h. The use of illegal substances or engaging in illegal activities on the property is strictly prohibited.
9. Damage and Security Deposit:
a. A security deposit may be required at the time of booking or check-in. The amount and payment method will be communicated at the time of booking.
b. The security deposit will be refunded, less any applicable deductions, within a reasonable time frame after your departure.
c. Deductions may be made for damages, excessive cleaning, unapproved additional guests, or breaches of these Terms and Conditions.
10. Additional Charges
a. Cairns Aquarius Holiday Apartments reserves the right to apply charges in the following circumstances:
i. Additional cleaning.
ii. Lost keys.
iii. Postal return of lost belongings.
a. Cairns Aquarius Holiday Apartments reserves the right to terminate a booking agreement without notice if any of these Terms and Conditions are breached.
b. In the event of termination, the guest(s) will be required to vacate the property immediately, and any accommodation fees paid will be forfeited.
c. Guests may cancel their booking in accordance with the Refund Policy outlined in Section 6.
b. By making a booking, you consent to the collection, use, and disclosure of your personal information for the purpose of processing your booking and managing your stay.
c. We may collect the following personal information from you:
I. Name, address, email address, phone number, and other contact details;
II. Credit card and billing information;
III. Information related to your booking, including dates, number of guests, and special requests;
IV. Travel details and travel documents, such as passport information;
V. Any other information necessary to provide our services or comply with legal requirements.
d. We use your personal information for the following purposes:
I. To process your booking and manage your stay at our property;
II. To communicate with you about your booking, including confirmations, reminders, and updates;
III. To provide customer support and respond to your inquiries or concerns;
IV. To improve our services and property offerings;
V. To comply with legal requirements and regulations.
e. We may disclose your personal information to third parties in the following situations:
I. To our service providers, such as payment processors, booking agents, and property management services, to facilitate your booking and stay;
II. To comply with legal requirements, such as law enforcement requests, court orders, or other legal processes;
III. To protect the rights, property, or safety of Cairns Aquarius Holiday Apartment, our guests, or others;
IV. In the event of a sale or transfer of our business or assets, to the extent necessary to complete the transaction.
f. We take reasonable steps to protect your personal information from unauthorized access, use, or disclosure. We store your information securely and implement appropriate technical and organizational measures to ensure its confidentiality and integrity. However, please be aware that no method of data storage or transmission is completely secure, and we cannot guarantee the absolute security of your information.
g. You have the right to access, correct, or delete your personal information held by Cairns Aquarius Holiday Apartment. To exercise these rights, please contact us with your request, and we will respond within a reasonable timeframe.
